The laws relating to dangerous drug offences in Queensland are contained within the Drugs Misuse Act 1986 and the Drugs Misuse Regulation 1987. There are two considerations when assessing the severity of possession charges. The first concerns the nature of the substance, while the second concerns the quantity which is calculated through analysing purity.

In relation to the nature of the substance, the Regulation provides a range of schedules. Schedule 1 contains illicit drugs such as, but not limited to methylamphetamine, heroin, cocaine, and MDMA. An offence relating to one of these illicit drugs can attract a more significant penalty. Schedule 2 on the other hand relates to illicit drugs such as cannabis, diazepam, and morphine. These are more commonly found in the community.

Possessing and Supplying Drug Charges

Types of Drugs

Types of dangerous drugs found in Schedule 1 offences include cocaine, heroin, lysergide (“LSD”), methylamphetamine (“ice”), and 3,4-Methylenedioxymethamphetamine (“ecstasy”).

Types of dangerous drugs found in Schedule 2 offences include cannabis (marijuana), methadone, morphine, gamma hydroxybutyric acid (“GHB”), and diazepam (“valium”).

Types of Offences

The type of illicit substance, the quantity, and the purpose for which it was used are key considerations with not only the charge, but the likely outcome. While there are many offences involving illicit substances, the most common offences include, but are not limited to:

Possessing relevant substances or things
Permitting use of place
Possess suspected property
Possession or possessing dangerous drugs
Selling or unlawfully supplying dangerous drugs
Trafficking in a dangerous drug

The most common offence is usually possession. Possession can relate to any type of illicit substance listed in either Schedule 1 or Schedule 2 of the Drugs Misuse Regulation. In relation to possessing dangerous drugs, it is not uncommon for people to possess a small amount of an illicit substance for personal use. Usually personal use drugs relate to cannabis, MDMA, cocaine, and methyl amphetamine.
