The laws relating to dangerous drug offences in Queensland are contained within the Drugs Misuse Act 1986 and the Drugs Misuse Regulation 1987. There are two considerations when assessing the severity of possession charges. The first concerns the nature of the substance, while the second concerns the quantity which is calculated through analysing purity.

In relation to the nature of the substance, the Regulation provides a range of schedules. Schedule 1 contains illicit drugs such as, but not limited to methylamphetamine, heroin, cocaine, and MDMA. An offence relating to one of these illicit drugs can attract a more significant penalty. Schedule 2 on the other hand relates to illicit drugs such as cannabis, diazepam, and morphine. These are more commonly found in the community.
